These Terms of Use ("Terms") govern your access to and use of the But I Have a Plan application and website ("Service"), operated by Delight in the Truth LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service.

2. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Auto-Renewable Subscriptions

The Service offers auto-renewable subscription plans that provide access to premium features. By subscribing, you agree to the following terms:

Free Trial: New users may be eligible for a free trial period of 30 days. If you do not cancel before the end of the trial period, your subscription will automatically convert to a paid subscription.
Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). For purchases made through the Apple App Store, payment will be charged to your Apple ID account at confirmation of purchase. For purchases made through the Google Play Store, payment will be charged to your Google Play account. For web purchases, payment is processed through Stripe.
Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
Plan Options: We currently offer a Monthly plan at $7.99/month and an Annual plan at $59.99/year. Prices are subject to change, and any price changes will take effect at the start of the next billing period following notice to you.
Cancellation: You may cancel your subscription at any time. For App Store and Google Play subscriptions, you must cancel through your device's subscription management settings. For web subscriptions, you may cancel through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No refunds will be provided for partial billing periods.
Managing Your Subscription: You can manage or cancel your subscription at any time by going to your account settings on the applicable platform (App Store, Google Play, or web).

4. User Content

You retain ownership of any content you create or upload through the Service ("User Content"). By using the Service, you grant us a limited license to store and process your User Content solely for the purpose of providing the Service to you. We do not claim ownership of your User Content.

5. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation;
Infringe upon the rights of others;
Transmit any harmful, threatening, abusive, or otherwise objectionable content;
Interfere with or disrupt the Service or its infrastructure;
Attempt to gain unauthorized access to the Service or its related systems.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Delight in the Truth LLC. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

7. Third-Party Services

The Service may contain links to or integrations with third-party services (such as payment processors and authentication providers). We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by the use of any such third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELIGHT IN THE TRUTH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or using the account deletion feature within the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Denton County, Texas.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms within the Service and updating the "Effective as of" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
